Welcome to FastUPIGateway, operated by Koshyari Communication ("we", "us", "our"). By accessing or using our platform, website, or API services (collectively "Services"), you ("Merchant", "you") agree to be bound by these Terms & Conditions. Please read them carefully.

1. Nature of Service

FastUPIGateway is a software tool that helps merchants generate UPI payment links and QR codes so that customers can pay directly to the merchant's own linked UPI ID or bank account. We are a technology facilitator and not a Payment Aggregator, bank, or financial institution. We do not hold, collect, pool, or settle funds on behalf of any merchant. All payments flow directly between the customer and the merchant's own UPI/bank account.

2. Merchant Responsibilities

• You must provide accurate business, KYC, and UPI details.
• You are solely responsible for the UPI ID / bank account you connect and for any funds received into it.
• You must comply with all applicable Indian laws, RBI guidelines, NPCI/UPI rules, and tax obligations.
• You must not use the Services for any illegal, fraudulent, or prohibited activity (including gambling, unauthorized financial services, or any activity barred by your bank or NPCI).
• You are responsible for your own customer support, order fulfilment, and dispute handling.

3. Account & Subscription

New merchants may receive a limited number of free transactions. Continued use beyond the free limit requires an active paid subscription plan. Subscription fees are for access to our software tools and are separate from any transaction amounts, which never pass through us.

4. Fees

We charge subscription fees for use of our software as displayed on your dashboard. We do not deduct any commission from your customer payments, as those funds go directly to your account.

5. No Liability for Transactions

Since funds move directly between customer and merchant, we are not responsible for failed, delayed, disputed, reversed, or fraudulent transactions. Any payment dispute is strictly between the customer, the merchant, and their respective banks/UPI providers.

6. Service Availability

We aim for high uptime but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the Services at any time. We are not liable for losses arising from downtime, technical failures, or third-party (bank/NPCI/UPI) outages.

7. Suspension & Termination

We may suspend or terminate any account that violates these Terms, engages in suspicious or fraudulent activity, or is flagged by banking/regulatory authorities, without prior notice.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim shall not exceed the subscription fees paid by you in the preceding one (1) month. We are not liable for indirect, incidental, or consequential damages.

9. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of India. Any disputes are subject to the jurisdiction of the courts of Uttarakhand, India.
